What is Probate?
Probate is the legal process that takes place after someone passes away. It involves proving the will (if there is one), identifying and valuing assets, paying debts and taxes, and distributing what’s left to heirs.
When is Probate Required?
It depends on how big the estate is. In Illinois, if the value of the estate is less than $100,000 and there is no real estate passing through a will or through state intestacy law if there is no will, then probate is not required, but may still be advisable in certain situations. If the value of the estate is greater than $100, 000 or there is real estate passing through a will or intestacy law (if there is no will), then probate is required. It can be a tricky question, so it’s best to consult with an attorney on your particular circumstances.
